The issue between ATSSAN , the Labour Union representing some workers in Bi Courtney was resolved yesterday with the intervention of the Federal Ministry of Labour and other stakeholders in the Aviation Industry. Bi Courtney had laid off some of its staff due to declining productivity and the need to enhance the efficiency of the most well run Airport Terminal in Nigeria. The unions contention is that the new conditions of service signed in 2021 should be applied to the members of staff retrospectively. BASL’s position is that Agreements take effect from the day it was signed and that it is against convention and law to apply an Agreement retrospectively unless their is an express provision to that effect which in this case does not exist. Bicourtney states that it has been a very disciplined organization. It had never defaulted or delayed in paying salaries and allowances in its fifteen years of operation. It even paid full salaries during the lockdown occasioned by COVID, which remains an exception in the aviation Industry. The resolution arrived at by the meeting is that the workers should be recalled and paid one month salary. The issue of the proper structure of the severance pay will be resolved within thirty days. The said workers should not return to work. BASL remains alarmed by the unlawful conduct of the Union members who gave no Notice of the Industrial action and were able to disrupt the activities of a major public institution without cause. This was done even in the face of a court order from the Industrial Court restraint them from this course of conduct. The appeal of the Nigerian Police force was discoutenanced by the Unions without consequence.
