The Appeal Court sitting in Lagos has overturned the conviction of managing director of Optimal Cancer Care Foundation, Femi Olaleye who was accused of rape.
In October 2023, Justice Rahman Oshodi of the special offences and domestic violence court in Lagos sentenced Olaleye to life imprisonment following a two-count charge of defilement of a child and sexual assault by penetration.
But in today’s ruling, the three member panel led by Jimi Bada held that the lower court erred in its judgment as it had no direct evidence to the claims.
The Court added that the main witness in the case who was Olaleye’s wife Oluremi was a tainted witness as her conduct showed that she was motivated by greed and the desire to take over the appellant’s assets upon his incarceration.
The appeal court thereafter discharged and acquitted Olaleye.
