The Supreme Court has upheld the Federal Government’s appeal challenging the verdict of the Appeal Court which dismissed the charges against the leader of the proscribed indigenous people of Biafra, Nnamdi Kanu.
The Supreme Court in the judgement delivered by Justice Emmanuel Agim, held that the Court of Appeal was wrong to rule that Kanu could not be tried again based on the illegality perpetrated against him by the Federal Government, following the invasion of his home and his forceful extradition from Kenya.
According to the Court, at the moment, the remedy for such an action is for Kanu to file a civil matter against the act instead of attempting to usurp the powers of the courts to continue with his trial for alleged criminal charges.
In a statement by former minister of justice and Kanu’s lead counsel, Kanu Agabi, the verdict of the court is binding but his team has been enlightened and motivated to re-examine their approach in the quest to get justice for their client.
However, counsel to the federal government, Tijani Gazzali, argued that the ruling is victory against illegality, noting that the court has reaffirmed the grip of the law and the unbiased stance of justice over unpatriotic agenda.
