EMEFIELE Vs EFCC – COURT STRIKES OUT COUNTS 1 to 4 in charges against Emefiele.
Following an appeal by Emefiele’s counsel mr Lekan Ojo (SAN) , the Appeal court of Nigeria, Lagos division had in Nove2024, directed the High Court of Lagos State presided over Honourable Justice Abdulrahman Ishodi to hear and determine Emefiele’s motion on Notice dated and filed on April 24, 2024, challenging the Jurisdiction of the High Court of Lagos state on charges preferred against Emefiele.
In its ruling delivered on 8th January 2025, the High Court of Lagos state upheld the preliminary objection of Emefiele to count 1 to 4 of amended information and struck out the said counts 1 to 4 on the grounds that the offences of abuse of office by Emefiele on counts 1 to 4 are unknown to law. In respect of the other counts the Court dismissed Emefiele’s preliminary objection by holding that the High Court of Lagos has the territorial jurisdiction to hear the case. Further hearing in the case has been adjourned to February 24 , 2025.
