Justice Donatus Okorowo of the Federal High Court, Abuja, has disqualified the governorship candidate of the All Progressives Congress (APC) Bayelsa State, Timipre Sylva from contesting the November 11 governorship.
In a ruling today, Justice Okorowo ruled that Sylva, having been sworn in twice and served five years as governor of the state, would breach the 1999 constitution as amended if allowed to contest again.
The judge referenced the case of Marwa vs Nyako, noting that constitution only allows two terms of eight years for an individual, stating that Sylva was not qualified to run in the November poll because if he wins and is sworn in, he would spend more than eight years in office as governor of the state.
The suit was filed on June 13, 2023, by Deme Kolomo, a member of the APC, sought to disqualify the former minister on grounds of previous governorship terms.
